This Privacy Policy explains how PSYKHE Corp., trading as PSYKHE AI (“PSYKHE AI,” “we,” “us,” or “our”), collects, uses, and shares information in connection with our website at psykhe.com (the “Site”) and our B2B taste intelligence and product personalization services (the “Services”).

PSYKHE AI is a business-to-business software company. Our Services are provided to enterprise retailers (our “Customers”) to power product personalization on their digital properties. This policy describes both (a) how we handle information collected directly through our Site and in our business interactions with you, and (b) our limited role when you interact with a retailer that uses our Services.

1. Who We Are

PSYKHE AI is the trading name of PSYKHE Corp., a Delaware corporation with its principal place of business at 1209 Orange Street, Wilmington, DE 19801, United States. PSYKHE Corp. is the legal entity responsible for this Site and for the information practices described in this policy. References elsewhere to PSYKHE Ltd. refer to an affiliated entity within the PSYKHE group of companies; PSYKHE Corp. is the controller for purposes of this policy unless otherwise indicated.

2. Our Two Roles

PSYKHE AI's relationship to personal information depends on the context in which it is collected:

2.1 When you interact with PSYKHE AI directly (our Site and business communications)

When you visit psykhe.com, submit a contact form, request a demo, subscribe to our updates, or communicate with us as a business prospect, partner, or vendor, PSYKHE AI acts as a controller (or “business” under applicable U.S. state privacy laws) of the information you provide. This policy governs those interactions.

2.2 When you interact with a retailer that uses PSYKHE AI's Services

When you visit or shop on a retailer's website or app that uses PSYKHE AI's Services, the retailer is the controller (or “business”) of your personal information. PSYKHE AI acts as a service provider or processor on behalf of that retailer, and processes information only on the retailer's documented instructions and in accordance with our contract with them.

In that context, the retailer's own privacy policy governs your rights and explains what information is collected and how it is used. PSYKHE AI does not determine the purposes or means of processing for that information and does not use it for our own independent commercial purposes. To exercise your privacy rights regarding that information, please contact the retailer directly.

The remainder of this policy primarily describes PSYKHE AI's practices as a controller under Section 2.1.

3. Information We Collect Through Our Site and Business Interactions

Through psykhe.com and our direct business communications with you, PSYKHE AI may collect the following categories of information:

4. How We Use Information

We use the information described in Section 3 to:

  • Respond to your inquiries, provide demos, and communicate about our Services.
  • Manage and conduct our business relationships with prospective and current Customers, partners, investors, and vendors.
  • Send marketing communications where you have opted in, and measure the effectiveness of those communications.
  • Operate, secure, and improve our Site, including analyzing traffic and usage patterns.
  • Comply with legal obligations, enforce our terms, and protect our rights and the rights of others.

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising, as those terms are defined under applicable U.S. state privacy laws.

5. How We Share Information

PSYKHE AI shares information only as necessary and with appropriate safeguards. The categories of recipients include:

  • Service providers and sub-processors. Including our cloud infrastructure provider (Google Cloud Platform), analytics providers, email and customer relationship tools, and similar vendors who process information on our behalf under written contracts.
  • Professional advisors. Legal, accounting, and other advisors, subject to obligations of confidentiality.
  • Corporate transactions. In connection with a merger, acquisition, financing, or sale of assets, information may be transferred to the relevant counterparties and their advisors, subject to customary confidentiality protections.
  • Legal requirements. Where required by law, legal process, or to protect the rights, property, or safety of PSYKHE AI, our Customers, or others.

6. What PSYKHE AI Does and Does Not Receive in Its Service Provider Role

For transparency, the table below summarizes what PSYKHE AI does and does not receive when acting as a service provider to a retailer under Section 2.2. This information is governed by our contract with the retailer and by that retailer's privacy policy.

PSYKHE AI does not handle payment or financial data and does not receive special category or sensitive personal information.

Pseudonymous identifiers may constitute personal information under applicable U.S. state privacy laws. PSYKHE AI processes them only to provide the Services on the retailer's instructions.

7. Cookies and Similar Technologies

Our Site uses cookies and similar technologies to operate the Site, remember your preferences, and analyze usage. We use:

  • Strictly necessary cookies required for the Site to function (such as session and security cookies).
  • Analytics cookies to understand how visitors use the Site, which pages are most visited, and how we can improve the experience.

You can control cookies through your browser settings and through the cookie preferences tool on our Site where available. Disabling cookies may affect certain Site functions.

8. Data Security

PSYKHE AI maintains a written information security program that includes administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, disclosure, alteration, or destruction. These measures include encryption of data in transit (TLS 1.2 or higher) and at rest (AES-256), role-based access controls, multi-factor authentication for production access, network segmentation, and regular vulnerability management. Additional detail is available on request under appropriate confidentiality arrangements.

9. Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, including to operate our business, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the category of information and the purpose of processing.

For information processed on behalf of a retailer Customer, retention is governed by our contract with that Customer. Upon termination or at the Customer's request, PSYKHE AI will delete or return such information within the timeframe specified in that contract (typically within thirty (30) days), subject to legal retention obligations and standard backup cycles.

10. Your Privacy Rights

Depending on where you reside and subject to applicable law, you may have the following rights regarding personal information PSYKHE AI holds about you as a controller:

  • The right to know or access the personal information we hold about you.
  • The right to request correction of inaccurate personal information.
  • The right to request deletion of your personal information, subject to legal exceptions.
  • The right to opt out of the sale or sharing of personal information. PSYKHE AI does not sell or share personal information for cross-context behavioral advertising.
  • The right to opt out of marketing communications at any time by using the unsubscribe link in any marketing email or by contacting us.
  • The right to non-discrimination for exercising your privacy rights.

To exercise these rights, please contact us using the details in Section 13. We may need to verify your identity before responding to a request, and we will respond within the time periods required by applicable law. If you authorize an agent to make a request on your behalf, we may require reasonable verification of that authorization.

If your personal information was provided to PSYKHE AI as a service provider by a retailer, please direct your request to that retailer. PSYKHE AI will assist the retailer as required under our contract.

11. Children

Our Site and Services are not directed to children under the age of 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

12. International Data Transfers

PSYKHE AI is headquartered in the United States, and information we collect may be processed in the United States or in other jurisdictions where our service providers operate. Where required by applicable law, we implement appropriate safeguards for international transfers of personal information.
